This End User License Agreement ("Agreement") outlines the terms under which you may install and use the FlashTest installation tool and its associated software ("Installer" and "Software"). By downloading, installing, or using FlashTest, you acknowledge that you have read and agreed to these Terms, forming a binding agreement between you and FlashTest ("Company," "we," "us," or "our").
All components of the Installer and Software including features, modules, security elements, and code are the property of FlashTest or its licensors. Your use of the Software is permitted solely under this Agreement, which governs all related functionalities.
By installing or using the Software, you confirm that you understand and accept these Terms and will comply with all applicable laws. If you disagree with any term, you must immediately uninstall the Software and discontinue use.
For stability and performance, FlashTest may collect limited technical information. We encourage reviewing our Privacy Policy before installation.
By starting the installation, you authorize FlashTest to install the Software and any necessary components.
By proceeding, you acknowledge that these terms will govern your use of any other feature or default setting that is provided as part or in addition to the FlashTest (as you agreed to during download or installation) and that you accept the terms governing these functions.
FlashTest grants you a personal, non-exclusive, revocable, and non-transferable license to install and use the Software for non-commercial purposes.

Any violation may result in immediate termination of access and possible legal action.
The Software may include or link to advertisements, search utilities, or external content. FlashTest does not control or endorse third-party services and assumes no responsibility for their reliability, accuracy, or safety. Interactions with such content are at your own risk.
You agree to use the Software only as permitted and not to interfere with its operation, security, or intended functionality. Misuse may lead to account termination or other consequences.
All intellectual property rights including trademarks, code, interfaces, and design elements remain solely with FlashTest or its licensors. This Agreement grants no ownership rights, only limited usage rights.
The Software is provided "as is" and "as available." FlashTest does not guarantee uninterrupted service, error-free performance, or compatibility with all devices. You assume all risks related to installation and use.
To the fullest extent permitted by law, FlashTest shall not be liable for:
If liability cannot be excluded, the maximum claim amount shall not exceed the greater of: (i) USD $10 or (ii) the amount paid for the Software.
FlashTest may release updates, patches, or enhancements. Depending on your settings, updates may install automatically. By using the Software, you consent to receiving such updates. Temporary disruptions caused by updates are not the Company's responsibility.
This Agreement remains effective until terminated by either party. You may uninstall the Software at any time to terminate the Agreement.

You agree to defend and indemnify FlashTest, its employees, partners, and affiliates against any claims arising from:
FlashTest may revise this Agreement at any time. Updated Terms become effective upon publication. Continued use after modifications constitutes acceptance.
If any provision is found unenforceable, remaining sections remain valid. Failure to enforce a right does not constitute a waiver. Rights may not be transferred without written approval.
This Agreement is governed by Israeli law. Disputes shall be resolved exclusively in Tel Aviv courts. Any claim must be filed within twelve (12) months of the event or be permanently barred.
FlashTest is not responsible for delays or service failures caused by events beyond its reasonable control, including natural disasters, outages, or government restrictions.
